PHOENIX (KPNX/KTVK/KPHO/CNN/CNN Newsource/WKRC) - The mother of a toddler who was found alive in a morgue is speaking out.

An Arizona family is demanding answers after their toddler was mistakenly declared dead and later found breathing in a room used as a hospital morgue.

Vincent Fiordilino is alive and recovering eight months after he nearly drowned in a backyard pool in a Phoenix suburb.

Police records show the toddler was found floating face down in the pool in February. His mother, Alexus Fiordilino, told KTVK that the family was told their son would suffer. She said they agreed to let a physician declare him dead.

“We had to leave and, yeah, he was taken to the morgue,” Alexus Fiordilino told KTVK.

About five and a half hours later, she received a call that Vincent had been found alive, she told KTVK. The family’s attorney, John Brewer, told KTVK a medical transport company discovered the toddler still breathing while transporting him to the medical examiner.

“Um, and all four extremities were moving underneath the sheet,” Brewer told KTVK.

Mercy Gilbert Medical Center, where Vincent was taken, told KTVK in a statement earlier this year that it conducted “a thorough review of all aspects of the care provided to learn what happened and to make meaningful changes to strengthen our care.”

The family’s attorney told KTVK one critical test result was not considered and another test was not performed before Vincent was declared dead.

“He was 5.5 hours without medical care or treatment,” Brewer told KTVK.

An attorney for a physician involved in the case told KTVK in a partial statement in July that “there is much more to this case, both factually and medically, than has been reported thus far.”
