October 9th, 2026 will go down in history as quite possibly the single biggest day for the Second Amendment in over a century. The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Department of Justice have officially thrown in the towel and issued uniform nationwide enforcement guidance: the National Firearms Act (NFA) is effectively dead for short-barreled rifles, short-barreled shotguns, silencers, and AOWs.
Following the landmark federal court injunction, the Department of Justice announced it will exercise its enforcement discretion uniformly across the entire country—meaning you no longer have to be an individual plaintiff to receive protection. As of October 9, the ATF will no longer require individuals to seek prior agency approval or register these items in the National Firearms Registration and Transfer Record (NFRTR).
However, before celebrating blindly, there are 5 critical caveats hidden in this administrative open letter that every gun owner must understand before taking action. Today on ARFCOM News, we break down the exact wording of the DOJ's announcement, the federal limits, and why your state line still matters.

The 5 Critical Caveats You Must Know:
1. Commercial Entities ("In the Business"): FFLs and commercial manufacturers are still bound by their statutory definitions and existing commercial tax structures.
2. Machine Guns & Destructive Devices: This enforcement rollback does NOT touch machine guns or destructive devices.
3. GCA Prohibitions Intact: The Gun Control Act of 1968 remains fully in effect; prohibited persons remain disqualified under federal law.
4. Form 20 Interstate Transport: The ATF still notes interstate movement notifications (Form 20s) for SBRs and SBSs, leaving unresolved administrative questions.
5. State & Local Laws ("Behind Enemy Lines"): The open letter does not preempt restrictive state-level bans or registries. If you live in an anti-2A state with independent statutes, those local prohibitions remain enforceable.
