The U.S. Supreme Court has ruled that police access to Google Location History is a search under the Fourth Amendment—a major victory for digital privacy.
As part of our Supreme Court Special, we break down Chatrie v. United States, the Supreme Court's latest landmark Fourth Amendment decision involving Google geofence warrants, cell phone location data, and the limits of government surveillance.
After a bank robbery, police obtained a geofence warrant demanding Google hand over the location data of every device within a 150-meter radius of the crime scene. That sweep included innocent customers, employees, and passersby—including Okello Chatrie.
The Court held that accessing historical Google Location History invades a person's reasonable expectation of privacy, even if:
* The search covers only a short period of time (two hours, in this case)
* The data is held by a third-party company like Google
* The government argues the information isn't especially revealing
Building on Carpenter v. United States, they found that Google geofence warrants raise serious Fourth Amendment concerns, and they can't just rely on the "good-faith exception."
The judgement made a dissenting Alito go a bit crazy and talk about how this would lead to "revolutionary developments" in how the Fourth Amendment is applied to personal information.
I don't see how that's a bad thing!
