SCOTUS Protects Women Athletes

Description

The U.S. Supreme Court has issued a landmark ruling affirming that Title IX allows schools to maintain separate women's and girls' sports based on biological sex, marking one of the most significant decisions in the ongoing national debate over transgender athletes and women's rights.

As part of our Supreme Court Special, I break down the Court's decision and highlight key excerpts from Justice Brett Kavanaugh's majority opinion explaining why the Equal Protection Clause and Title IX permit schools to restrict girls' and women's sports to biological females in order to preserve safety, competitive fairness, and equal athletic opportunities.

The whole point of Title IX is to give opportunities for female athletes, without them having to compete against biological men. Schools therefore have the right to separate sports teams based on biological sex.

Justice Kavanaugh also addressed concerns raised by the dissent, stating that while the Court recognizes the challenges faced by transgender-identifying students, it must also consider the effects on female athletes who are required to compete against biological males.

The women who fought so hard for their own sports teams are the very ones oppressed by these violations. The Supreme Court said, no more!
